Abstract

The article deals with the problems of putting the boundaries of territorial zones on the state cadastral registration, the main of which is the impossibility to enter information about the zones into the Unified State Real Estate Register due to the presence of registry errors on this territory. The article points out that in order to keep the data of the Unified State Real Estate Register up-to-date, it is necessary to constantly update information on new land plots being formed, as well as the boundaries of municipalities and territorial zones. The article discusses the problems arising in the process of entering information on the boundaries of territorial zones into the Unified State Register of Immovable Property and proposes the main ways of solving them.

ПРОБЛЕМЫ ПОСТАНОВКИ ТЕРРИТОРИАЛЬНЫХ ЗОН НА ГОСУДАРСТВЕННЫЙ КАДАСТРОВЫЙ УЧЕТ

В статье рассматриваются проблемы постановки границ территориальных зон на государственный кадастровый учет, основной из которых является невозможность внесения сведений о зонах в Единый государственный реестр недвижимости из-за наличия регистрационных ошибок на данной территории. В статье отмечается, что для поддержания актуальности данных Единого государственного реестра недвижимости необходимо постоянно обновлять информацию о формируемых новых земельных участках, а также о границах муниципальных образований и территориальных зон. В статье рассматриваются проблемы, возникающие в процессе внесения сведений о границах территориальных зон в Единый государственный реестр недвижимого имущества, и предлагаются основные пути их решения.

One of the main documents in urban planning is the master plan of the cities and settlements. It establishes the boundaries of the settlements on the basis of which the development of this territory. Development is planned in the social, economic and environmental spheres. In addition to master plans, there is also such a normative-legal document as the rules of land use and development of the territory. It establishes the boundaries of territorial zones and includes urban planning regulations that determine the types and parameters of permitted use, the maximum and minimum sizes of land plots and other characteristics that allow carrying out urban planning and cadastral activities within the boundaries of these zones [1].

Information on the boundaries of territorial zones is entered into the Unified State Register of Immovable Property. This procedure is carried out after the preparation of a coordinate description of the location of the boundaries of territorial zones. Legal documents, as well as cartographic material, orthophotos and information contained in the Unified State Register of Immovable Property shall be used to prepare a coordinate description of the location of the boundaries of territorial zones. The requirements for submitting information in XML format are presented in Fig. 1 [2].

The Documents to be included in the Unified State Register of Legal Entities must be signed by an electronic digital signature of the person responsible for the documents and decision to approve the PZZ.

There are a number of peculiarities in the state cadastral registration of territorial zones. Thus, territorial zones cannot cross the boundaries of settlements, boundaries of municipalities, land plots [3]. In addition, territorial zones cannot cross each other, as well as cannot cross the boundaries of forestries. Therefore, the most common problem that arises when establishing the boundaries of territorial zones is a registry error in the information of the Unified State Real Estate Register on the location of the boundaries of a land plot. The registry error in the information on real estate objects (land plots) in the territory of the rural settlement "Tumnin settlement" zone G and Datta rural settlement zone G is presented in Fig. 2 and Fig. 3. land municipality territorial

The drawings show the overlap of two land plots; as a result of this overlap, the intersection of a territorial zone with a land plot is also revealed, which prevents the entry of information on the boundaries of territorial zones in the USRN. In this case, it is necessary to correct the registry error.

A registry error can be corrected only as a result of the receipt by the rights registration authority of the documents to contain the information about a corresponding error, the reasons for its occurrence, as well as information necessary to correct such an error. Thus, in order to correct it, it is necessary to receive the documents to contain the error and correct information about the real estate object. In this case, to correct the error we turned to a cadastral engineer who prepared boundary plans to correct the cadastral error [4].

Preparation of a boundary plan by a cadastral engineer consists of several stages: preparatory, field and cameral. The procedure for the boundary coordination and the date of cadastral works, as well as the procedure and date of signing the act of boundary coordination are established.

The act of boundary coordination is a legal guarantee for the owners of adjacent land plots of the reliability of information on the boundaries of immovable objects. In the case under consideration, the changes made should be agreed upon individually with the owners of adjacent land plots with cadastral numbers 27:04:0401001:323 and 27:04:0901002:3

As a result of all the stages of preparing a boundary plan, the final document is handed over to the customer to submit an application for correction of a register error to the rights registration authority - Rosreestr, for making a final decision and making changes to the data of land plots under state cadastral registration. Further, when register errors are corrected in the information of the Unified State Register of Real Estate of land plots, it will be possible to register the boundaries of territorial zones on the state cadastral register.

Conclusion

Thus, the establishment of the boundaries of territorial zones is an important task that allows resolving disputes arising between the right holders of land plots. Reliable information on the location of the boundaries of territorial zones makes it possible to eliminate the problem of crossing the boundaries of land plots.

It is also necessary to develop a number of measures for a comprehensive correction of the registry errors to improve the efficiency of preparing coordinated descriptions of territorial zones. The proposed solutions will significantly reduce the probability of errors when drafting territorial zone boundaries and improve the reliability and relevance of information contained in the Unified State Real Estate Register.
