By the president of Republic the citizen of Republic on a birth can be selected, is not younger than forty years, freely owning a state language and living in Kazakhstan not less than fifteen years.

The next presidential elections of Republic are spent to the first Sunday of December and cannot coincide on terms with elections of new structure of Parliament of Republic.

The candidate who has typed more of fifty percent of voices of voters, taken part voting, is considered the selected works. In case any of candidates has not typed the specified poll, repeated voting in which two candidates who have typed a greater poll participate is taken. The selected works the candidate who has typed a greater poll of voters, taken part in voting is considered.

The president of Republic Kazakhstan enters a post from the moment of bringing to people of the following oath: " solemnly I swear truly to serve people of Kazakhstan, strictly to follow the Constitution and laws of Republic Kazakhstan, to guarantee the rights and freedom of citizens, honesty to carry out the high duties of the President of Republic Kazakhstan assigned to me ".

The oath is brought in the second environment of January in solemn conditions at presence of deputies of Parliament, members of the Constitutional advice, judges of the Supreme court, and also all former Presidents of Republic. In case of, stipulated by clause 48 of the Constitution, the person who has taken up powers of the President of Republic Kazakhstan, the oath is brought within one month from the date of acceptance of powers of the President of Republic.

Powers of the President of Republic stop from the moment of the introduction into a post of again selected President of Republic, and also in case of preschedule clearing or dismissal of the President of a post or its death. All former Presidents of Republic, except for released from a post, have a rank of the Ex-president of Republic Kazakhstan.

The same person cannot be selected by the President of Republic more than two times successively.

The president of Republic Kazakhstan has not the right to be the deputy of a representative body, to borrow other paid posts and to carry out enterprise activity.

For the period of realization of the powers the President of Republic stops the activity in political party.

The president of Republic Kazakhstan:

1) addresses with the annual message to people of Kazakhstan about position in the country and the basic directions internal and foreign policy of Republic;

2) appoints the next and extraordinary parliamentary elections of Republic; convokes the first session of Parliament and takes the oath its deputies to people of Kazakhstan; convokes extraordinary joint sessions of Chambers of Parliament; signs presented by the Senate of Parliament the law within fifteen working days, will promulgate the law or returns the law or its separate clauses for repeated discussion and voting;

3) with the consent of Parliament appoints to the post of the Prime minister of Republic; dismisss it; on representation of the Prime minister defines structure of the Government of Republic, appoints to the post and dismisss its members, and also forms, abolishes and will reorganize the central agencies of Republic which are not a part of the Government; takes the oath members of the Government, presides over sessions of the Government on especially important questions; charges to the Government entering of the bill into Mazhilis of Parliament; cancels or stops in full or in part action of certificates of the Government and акимов areas, cities of republican value and capital of Republic;

4) with the consent of Parliament appoints to the post of chairman of national bank of Republic Kazakhstan; dismisss it;

5) with the consent of the Senate of Parliament appoints to the post of the general public prosecutor and chairman of committee of national safety of Republic; dismisss them;

6) appoints and withdraws chapters of diplomatic representatives of Republic;

7) appoints to the post for the period of five years of chairman and two members счетного of committee under the control over execution of the republican budget;

8) approves the state programs of Republic;

9) on representation of the Prime minister of Republic approves uniform system of financing and a payment of workers for all bodies containing due to the state budget of Republic;

10) makes a decision on carrying out of a republican referendum;

11) negotiates and signs international договоры Republics; signs instruments of ratification; accepts accrediting and letters of recall of diplomatic at it diplomatic and other representatives of the foreign states;

12) is Supreme commander in chief armed forces of Republic, appoints to the post and dismisss the Maximum command of Armed forces;

13) awards with the state awards of Republic, appropriates honourable, maximum military and other ranks, class grades, diplomatic ranks, qualifying classes;

14) solves questions of citizenship of Republic, granting of a political asylum;

15) carries out the pardon of citizens;

16) in case of when democratic institutes, independence and territorial integrity, political stability of Republic, safety of its citizens are under serious and direct threat and it is broken normal functioning the constitutional bodies of the state, after official consultations of the Prime minister, chairmen of Chambers of Parliament of Republic application of armed forces of Republic, with immediate informing on it of Parliament of Republic takes the measures dictated by named circumstances, including introduction in all territory of Kazakhstan and in its separate districts of state of emergency;

17) in case of aggression against Republic or direct external threat of its safety enters in all territory of Republic or in its separate districts the martial law, declares partial or general mobilization and immediately informs on it Parliament of Republic;

18) forms subordinates to it a protection service of the President of Republic and republican guards;

19) appoints to the post and dismisss the state secretary of Republic Kazakhstan, defines its status and powers; forms administration of the President of Republic;

20) forms secutiry council, the Maximum Judicial advice and others it is advisory-advisory bodies;

21) carries out other powers according to the Constitution and laws of Republic.

The president of Republic Kazakhstan on the basis of and in execution of the Constitution and laws, publishes decrees and the orders having a binding force in all territory of Republic.

In case of, stipulated by subitem 4) clauses 53 of the Constitution, the President of Republic publishes laws, and in case of, stipulated by item 2 of clause 61 of the Constitution - the decrees which are valid laws of Republic.

The certificates of Parliament signed by the President of Republic, and also the certificates of the President published under the initiative of the Government, preliminary are ratified accordingly chairman of each of Chambers of Parliament or the Prime minister to whom the legal responsibility for legality of the given certificates is assigned.

The president of Republic Kazakhstan, its honour and advantage are inviolable.

The final decision on the given question is accepted at joint session of Chambers of Parliament by the majority not less than three quarters from the general poll of deputies of each of Chambers at presence of the conclusion of the Supreme court about validity of charge and the conclusion of the Constitutional advice about observance of the established constitutional procedures. Nonacceptance of the final decision within two months from the moment of presentation of charge entails a recognition of charge against the President of Republic rejected. The deviation of charge of the President of Republic in fulfilment of high treason at its any stage entails the preschedule termination of powers of deputies of the Mazhilis initiated consideration of the given question.

The question on dismissal of the President of Republic from a post cannot be raised during consideration of a question by it about the preschedule termination of powers of Parliament of Republic.

In case of preschedule clearing or dismissal of a post of the President of Republic Kazakhstan, and also its death of power of the President of Republic for the remained term pass to chairman of the Senate of Parliament; at impossibility of chairman of the Senate to take up they pass powers of the President to chairman of Mazhilis of Parliament; at impossibility of chairman of Mazhilis to take up they pass powers of the President to the Prime minister of Republic. The person who has taken up powers of the President of Republic, puts from itself accordingly powers of chairman of the Senate, chairman of Mazhilis, the Prime minister. In this case replacement of vacant state posts is carried out by way of, stipulated by the Constitution.

The person who has taken up powers of the President of Republic Kazakhstan, on the bases and by way of, stipulated by item 1 of present clause, has not the right to initiate change and addition in the Constitution of Republic Kazakhstan.
